Terms of Service

1. Agreement to terms

By accessing or using Inkury ("the Service"), operated by Inkury Pty Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of service

Inkury is a document editing platform that provides local-first document creation, editing, collaboration, and storage. The Service is available through web browsers and may be offered as a self-hosted deployment for Enterprise customers.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.

4. Your content

You retain all rights to the content you create, upload, or store in Inkury. We do not claim ownership of your content. We access your content only to provide and improve the Service, and as described in our Privacy Policy.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the Service or servers
• Upload content that contains malware or harmful code
• Use the Service to send unsolicited communications
• Reverse engineer or decompile any part of the Service

6. Payment and billing

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law. We may change our pricing with 30 days notice. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

7. Free trial

We may offer free trials of paid features. At the end of a trial, your account will revert to the Free tier unless you choose to subscribe. We will not charge you without your explicit consent.

8. Termination

You may close your account at any time. We may suspend or terminate your account if you violate these terms. Upon termination, you may export your data for 30 days. After 30 days, we will delete your data from our servers, though local copies on your devices remain yours.

9. Service availability

We aim to maintain high availability but do not guarantee uninterrupted access. The local-first architecture means your documents remain accessible on your device even when our servers are unavailable. We will provide reasonable notice of planned maintenance.

10. Limitation of liability

To the maximum extent permitted by law, Inkury Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.

12. Changes to these terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
